TERMS AND CONDITIONS

1. The below definitions shall apply to these terms and conditions:

The Provider is Dirty Debtors Limited;

The Website is www.dirtydebtors.co.nz; and

The User is the person logging the information on to the website.

2. By using this website the User accepts and agrees to comply with all of the below terms and conditions.

3. The User accepts that all or any information including any statement, representation or fact, or photograph that the User logs on to the website must be true and correct at all times.This is an ongoing obligation.The User further accepts that if any further change of information becomes known to the User, it must immediately be modified, edited or withdrawn from the website.

4. The User accepts that if at any time the nominated e-mail contact address becomes invalid, the Provider may at its sole discretion remove all postings provided by the User without notice.

5. The User accepts that the Provider has ultimate editorial control and oversight over the content of the website.While the website is a bulletin board hosting information posted by the Users, the Provider reserves the right to remove any misleading, offensive postings or information which is otherwise objectionable to the Provider for any reason whatsoever in its absolute discretion. .In this situation, the User forfeits all fees paid to the Provider.The Provider reserves the right to refuse to accept any further postings from the relevant User.Should any dispute arise as to the accuracy of information posted by any User, the Dispute Resolution process set out below should be followed.

6. The Provider does not condone violence or coercion.Any threats of violence or coercion or inappropriate language posted by the User will be subject to immediate removal at the Provider’s discretion.In this situation, the User forfeits all fees paid to the Provider.The Provider reserves the right to refuse to accept any further postings from the relevant User.

7. The User indemnifies the Provider against any claim or claims by any person or entity for compensation in respect to any matter or statement, representation, or fact posted to any website that the Provider permits and the User hereby warrants that all or any statement, representation, or fact is true and correct.

8. The User warrants and certifies that such statement, representation, or fact, including any photograph of the debtor is correct in all respects, and further does hereby provide a full and complete Indemnity to the Provider for all or any damages, losses, costs, or fines, awarded, howsoever incurred or suffered, either as result of any claim made by any person or entity arising from the User’s posting of information on the website.

PRIVACY AND DISPUTE RESOLUTION

1. The User must at all times comply with the principles of the Privacy Act 1993. The full text of the Privacy Act Principles is found here (create link to http://privacy.org.nz/information-privacy-principles).The User accepts that the relevant law must be reviewed and independent legal advice sought before posting any information.

2. The User must ensure that, as a minimum, all information posted must:

A. Be complete and accurate at all times;

B. Relate solely and specifically to the debt for the purpose of recovering the money owed. This means that no personal information is to be posted; and

C. Be verifiable by documentary evidence.

3. Should any debtor or third party wish to correct any information displayed on the website, the User should be contacted in the first instance. All reasonable steps must be taken to resolve the request with the User. If, after 14 days, the request cannot be resolved with the User, the Provider may be contacted. The Provider will then attempt to encourage the User to modify the relevant content and reserves the right to exercise its discretion and remove the relevant information posted by the User as it sees fit.

4. The Provider will remove any validly disputed listing within 48 hours after being contacted by any debtor or third party, provided any such party has attempted to resolve the dispute with the User and has failed to resolve that dispute within 14 days as outlined above.In this situation, the User forfeits all fees paid to the Provider.The Provider reserves the right to refuse to accept any further postings from the relevant User.

REFUND POLICY

  1. Refunds will be given at the sole discretion of the Dirty Debtors Ltd and will be judged individually.
  2. E-mail your request to info@dirtydebtors.co.nz and we will endeavour to reply to your request within 7 days.
  3. It is essential that you please include full circumstances and reasoning behind why a refund is required otherwise no request can be processed.
